ARTICLE 1 - Scope of application

 

These General Terms and Conditions of Sale apply, without restriction or reservation, to all sales concluded by the Company DOCOTRA (MAIN ROAD 650) whose registered office is located at 12 Rue Victor Chevreuil 75012 PARIS, registered with the PARIS Trade and Companies Registry under number 539 317 164 000 17 hereinafter referred to as "DOCOTRA SAS", ("the Seller") with consumers and non-professional buyers ("the Customers or the Customer"), wishing to acquire the products offered for sale by the Seller ("the Products") on the mainroad650 website.com website.

In particular, they specify the conditions of order, payment, delivery and management of any returns of Products ordered by Customers.

These General Terms and Conditions of Sale may be supplemented by special conditions, set out on the website, prior to any transaction with the Customer.

ARTICLE 4 - Orders

ARTICLE 5 - Tariffs

The prices indicated do not include delivery costs, which are invoiced in addition to the price of the products purchased according to the total amount of the order. In metropolitan France, for all orders, shipping costs are free. For the rest of the European Union, a flat-rate contribution to shipping costs will be invoiced to the Customer for a fixed amount of 12 euros including all taxes.

In the event of a special request from the Customer concerning the packaging or transport conditions of the products ordered, duly accepted in writing by the Seller, the related costs will be subject to a specific additional invoice, on the basis of a quotation previously accepted in writing by the Customer.

The payment requested from the Customer corresponds to the total amount of the purchase, including these fees.

An invoice is drawn up by the Seller and given to the Customer upon delivery of the Products ordered.

 

ARTICLE 6 - Deliveries

 

Upon confirmation of payment, the Products ordered by the Customer will be delivered in metropolitan France and the European Union to the address indicated by the Customer when ordering on the mainroad650.com website.

Delivery is the transfer of physical possession or control of the Product to the Customer.

Except in special cases or unavailability of one or more Products, the Products ordered will be delivered in one go.

The products ordered by the Customer will be delivered via the services of the French Post Office (COLISSIMO) to the address mentioned by the Customer when ordering and to which the carrier can easily access.

The DOCOTRA Seller may provide the Customer with the tracking number of his package by e-mail. The Customer will be delivered to his home by his postman. In the event of the Customer's absence, he will receive a delivery notice which will enable him to collect the products ordered from the nearest post office during the period indicated by the postal services.

If the Products ordered have not been delivered within 30 days after the indicative delivery date, for any reason other than force majeure or the Customer's fault, the sale may be cancelled at the Customer's written request under the conditions provided for in Articles L 216-2 L 216-3 L241-4 of the French Consumer Code. The sums paid by the Customer will then be returned to him at the latest within fourteen days following the date of termination of the contract, to the exclusion of any compensation or deduction.

 

ARTICLE 7 - Transfer of ownership - Transfer of risks

 

Regardless of the date of transfer of ownership of the Products, the transfer of the risks of loss and deterioration relating thereto shall only be carried out when the Customer takes physical possession of the Products. The Products therefore travel at the Seller's risk and peril.

 

ARTICLE 8 - Right of Withdrawal

 

In accordance with the legal provisions in force, the Customer has a period of fourteen days from receipt of the Product to exercise his right of withdrawal from the Seller, without having to justify his reasons or pay any penalty, for the purpose of exchange or reimbursement, provided that the Products are returned in their original packaging and in perfect condition within 72 hours of notifying the Seller of the Customer's decision to withdraw from the contract.

Returns are to be made in their original condition and complete (packaging, accessories, instructions ...) allowing them to be put back on the market in new condition, accompanied by the purchase invoice.

Damaged, used or incomplete Products are not taken back.

An acknowledgement of receipt will be immediately communicated to the Customer by the Seller. The terms and conditions for returning the Products will then also be specified to the Customer.

In the event of exercising the right of withdrawal within the aforementioned period, only the price of the Product(s) purchased and the delivery costs shall be reimbursed; the return costs shall be borne by the Customer.

The refund will be made within 30 days of receipt of the returned Products.

 

ARTICLE 9 - Liability of the Seller - Warranty

 

The Products sold on the mainroad650.com website comply with the regulations in force in France.

They benefit by right and without additional payment, independently of the right of retraction, in accordance with the legal provisions (in particular articles L217-4 and following of the Consumer Code),

The Seller shall reimburse or replace the Products delivered for which the Customer has duly proven the lack of conformity or defects.

If necessary, the return address of the defective Products will be specified to the Customer.

The return must be made within a maximum period of 15 days from the delivery of the Products and in the state in which they were received with all the elements (accessories, packaging, instructions, etc.).

Shipping costs will be reimbursed on the basis of the invoiced rate and return costs will be reimbursed on presentation of the receipts.

Refunds or replacements will be made as soon as possible and at the latest within 30 days following the Seller's discovery of the lack of conformity or latent defect.

The refund will be made by crediting the Customer's credit card.

The Seller shall not be held liable in the event of misuse, negligence or lack of maintenance on the part of the Customer, such as in the event of normal wear and tear of the Product, accident or force majeure.

The Seller's warranty is, in any event, limited to the replacement or reimbursement of Products that do not conform or are affected by a defect.

 

ARTICLE 10 - Protection of personal data

 

In accordance with the Data Protection Act of 6 January 1978, reinforced and supplemented by the RGPD (general regulations on data protection) which came into force on 25 May 2018, it is recalled that the personal data requested from the Customer is necessary to process his order and to issue invoices, in particular.

These data may be communicated to any partners of the Seller responsible for the execution, processing, management and payment of orders.

They are written in French. In the event that they are translated into one or more languages, only the French text shall be authentic in the event of a dispute.

 

ARTICLE 14 - Disputes

 

All disputes to which the purchase and sale operations concluded in application of the present general terms and conditions of sale could give rise, concerning their validity, interpretation, execution, termination, consequences and consequences and which could not be resolved between the seller and the Customer will be submitted to the competent courts under the conditions of common law.
